TFSC News & Things to Know


By law, the Commission is allowed to review its rules every four years. Our last major rule review was completed in 2015. Therefore, the agency will begin reviewing its rules this Spring. Additionally, we will be reviewing rules as they relate to our Sunset legislation. 
All meetings will start at 10 and take place in the Hobby Building Room 2-500 in Austin.
  • March 7 – Establishment licensing / standards to include discussion on prep room exemptions, prep room requirements, advertising, possible criminal background checks for owners, etc.;
  • March 26 – Enforcement procedures to include updated penalty schedule and inspections, etc.;
  • April 9 – Individual licensing  to include provisional licensing, continuing education, student loan defaults, etc.;
  • May 9 -Crematories, including inspection forms;
  • May 21 – Clean up & rules related to Sunset legislation (will include discussion about Sunset changes in each of the meetings above – but may need to readdress based on final bill language)

Thank you to all of those who could attend the last three stakeholder meetings! These meetings were good first steps in reviewing rules related to establishments,enforcement and individual licensing. Please know these meetings are a first step in the process. The Executive Director would welcome additional thoughts and concern regarding the rules. The Executive Director plans to place the propsed amendments to the rules on the June 18, 2019 Commission agenda for discussion.

At the March meeting, Commissioners voted to propose amendments to Chapter 204 relating to fees. The Commission’s fee structure needs to be amended as a result of action by the Department of Information Resources (DIR). DIR has instructed agencies to comply with the new surcharge amounts by the end of fiscal year 2019. The agency notes the fees paid by licensees either decrease or stay the same under this rule proposal. The rule was  published in the April 12, 2019, Texas Register for a 30 day public comment period. Final adoption is expected at the June 18, 2019 Commission meeting.

Chapter 204 Fees - Proposed Amendment



The Texas Electronic Vital Events Registrar (TxEVER) has replaced the current Texas Electronic Registrar (TER) system. TxEVER went live on January 1, 2019, to support all vital events operations. Look to the TxEVER page for more information.



HB 1540 is the legislation which adopts the Texas Sunset Advisory Commission recommendations and continues the agency for another 12 years. The bill was sent to the Governor on May 14, 2019. Governor Abbott must act on the bill by May 25, 2019.

The Commission's Invocation Policy authorizes a licensee in good standing to deliver the Invocation at Commission meetings. See the Executive Director's letter for further information.



When a person calls the main line he/she will hear a recorded message which states "You have reached TFSC, please wait while I transfer your call." At that point the call is transferred to licensing staff. The agency has two people responsible for answering the phone. If those two people are on the phone or away from their desks, the call then transfers to the agency voice mail.  If you are having a problem reaching staff or not having your phone calls returned, please email the Executive Director for assistance.

The TFSC does not staff the online renewal center and online help-desk. The HPC help-desk states it can take multiple days to respond to a help ticket, especially near the end of the month. The help-desk only responds to emailed help requests. TFSC licensing staff is able to help with resetting passwords or emails for the online renewal system. Contact Nikki Smith at for assistance.

The TFSC meets quarterly. Meetings are held in Austin, Texas, at the Hobby Building. Once posted, TFSC meeting agendas may be found by clicking on the following website: Texas Secretary of State Open Meetings. Type in Texas Funeral Service Commission in the “Agency Name” field and hit “Find.”
