CREMATORY OWNERS ANNUAL REPORT Texas Occupations Code 651.658 requires all crematories to report to the commission the number of cremations performed within a one year period. Texas Administrative Code 205.9 clarifies this with the time period being the calendar year and the report is due at the commission by January 30th of the following year. Failure to report by January 30th will result in a penalty of $100.00 per day until the report is received at the Texas Funeral Service Commission. New Crematory Establishments Pursuant to the Health and Safety Code, Chapter 716.003(b)(1)(2) A crematory, other than a crematory registered with the commission on September 1, 2003, must: (1) be adjacent to a perpetual care cemetery, funeral establishment and/or commercial embalming facility; and (2) be owned or operated by the person that owns or operate the perpetual care cemetery or funeral establishment and/or commercial embalming facility. Items required for licensing of a new crematory Completed Application *Regarding the Health and Fire Inspections If a local Health and Fire Department does not inspect crematories, then a letter on their respective letterhead stating the same will suffice. When all the documents have been received in this office and the crematory is ready, TFSC will inspect the facility. Once the facility passes the inspection, a licensed will be issued and the crematory will be ready for the manufacturer to train and certify the operators. A crematory may not cremate a case until it is licensed. CEMETERIES
